These Terms of Service (“Terms”) govern your access to and use of From Only Now (the “Service”), including our Android app and website. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
From Only Now lets people explore places through time-based captures (“capsules”), discover nearby offers and ads, and (for business accounts) manage promotions, ads, and a wallet. Features may change over time.
2. Eligibility & accounts
- You must be at least 13 years old (or the higher age required where you live) to use the Service.
- You must provide accurate account information and keep your credentials secure.
- You are responsible for activity under your account. Notify us promptly of unauthorized use.
- We may suspend or terminate accounts that violate these Terms or our Community Guidelines.
3. User content
You retain ownership of content you post. You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your content as needed to operate and promote the Service.
You represent that you have the rights to the content you post and that it does not violate law or others’ rights. We may remove content at our discretion, including content that violates these Terms or our Community Guidelines.
4. Prohibited uses
- Illegal activity, harassment, hate, exploitation, or threats.
- Spam, scams, malware, or unauthorized advertising outside approved business tools.
- Impersonation, scraping, reverse engineering, or interfering with the Service.
- Uploading unlawful, infringing, or deceptive content.
- Attempting to bypass location, payment, or moderation controls.
5. Location features
Some features need location access. By enabling location, you consent to collection and use of location as described in our Privacy Policy. You can disable location in device settings; nearby features may stop working.
6. Business accounts, ads & payments
Business features (offers, ads, wallet) may require additional profile information and payment. Ad and offer pricing may be set by us and shown in the product. Payments are processed by third parties such as PayPal; their terms also apply. Fees paid for placements are generally non-refundable except where required by law or expressly stated by us.
7. Intellectual property
The Service, branding, and our original materials are owned by From Only Now and its licensors. You may not use our marks without prior written permission.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, or that content from other users is accurate or safe.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FROM ONLY NOW AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.
10. Termination
You may stop using the Service at any time. You may request account deletion as described in the Privacy Policy. We may suspend or end access if you breach these Terms or if we discontinue the Service.
11. Changes
We may update these Terms by posting a new version on this page. Material changes will be reflected by the “Last updated” date. Continued use after changes constitutes acceptance where allowed by law.
12. Governing law
These Terms are governed by the laws of the United States, without regard to conflict-of-law rules, unless mandatory local consumer laws give you additional rights.
